Above-Ground Pool Recall – Bestway, Intex, and Polygroup: A Warning to Consumers and Whether you have a Lawsuit

Above-Ground Pool Recall: A Warning to Consumers and a Call for Accountability

Recent news of a nationwide recall of millions of above-ground swimming pools has sent a shockwave through the country, particularly for families who believed they were providing a safe way for their children to enjoy the summer. This recall, initiated by the U.S. Consumer Product Safety Commission (CPSC), involves some of the most popular brands on the market, including Bestway, Intex, and Polygroup.

The Danger: A Hidden Drowning Hazard

The recall pertains to above-ground pools that are 48 inches or taller and feature a specific type of compression strap system. This system, which wraps around the outside of the pool’s support legs, was found to pose a serious drowning hazard. The CPSC reports that these straps can create a foothold, allowing a small child to climb into the pool even if the ladder has been removed.

Tragically, this design flaw has been linked to the drowning deaths of nine children, ages 22 months to 3 years old, in incidents that occurred across California, Texas, Florida, Michigan, Wisconsin, and Missouri between 2007 and 2022.

What Does This Mean for Consumers?

If you own an above-ground pool from Bestway, Intex, or Polygroup, it is crucial to check if your model is part of the recall. The affected pools have been sold since 2002 at major retailers, including Walmart, Target, Sears, Lowe’s, and Costco, as well as online on Amazon and other websites.

The CPSC recommends that owners of the recalled pools immediately contact the manufacturer for a free repair kit. However, this action does not negate the potential for legal recourse for those who have been affected by this dangerous product.

The Role of Product Liability Law

In the United States, manufacturers have a legal obligation to design and produce safe products. When a product is designed with a dangerous defect—like a strap that doubles as a foothold for a toddler—and that defect leads to injury or death, the manufacturer can and should be held accountable. This area of law, known as product liability, is designed to protect consumers and hold corporations responsible for the harm their products cause.

Lawsuits in these cases are not just about financial compensation; they are about justice. They are about holding manufacturers accountable for failing to prevent foreseeable tragedies and ensuring that such dangerous products are removed from the market. They also provide a powerful incentive for companies to prioritize safety in their design and manufacturing processes.

Do You Have a Claim?

If you or a loved one has been injured or, tragically, a child has died in an incident involving one of these recalled pools, you may have grounds for a product liability lawsuit.
