1. Introduction and Scope

Klaproth Law PLLC (the “Firm,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information of visitors to our website, www.klaprothlaw.com, including any subpages and successor sites (collectively, the “Site”). This Privacy Policy describes the categories of personal information we collect through the Site, how we use and disclose that information, and the choices and rights available to you.

This Privacy Policy applies only to information collected through the Site. It does not apply to information we collect offline, through email or telephone communications outside the Site, or in the course of an attorney-client relationship, which is protected by the attorney-client privilege, the applicable rules of professional conduct, and our professional obligations of confidentiality. To the extent any information collected through the Site later becomes part of a client file, our professional obligations will govern.

By accessing or using the Site, you acknowledge that you have read and understood this Privacy Policy and consent to the collection, use, and disclosure of your information as described herein, including the processing of usage data by our third-party analytics provider as described in Section 4. If you do not agree with this Privacy Policy, please do not use the Site.

2. No Attorney-Client Relationship; Confidential Information

The Site is provided for general informational purposes and constitutes attorney advertising. Your use of the Site, including submitting information through a contact form or sending us an email through the Site, does not create an attorney-client relationship between you and the Firm. An attorney-client relationship is formed only upon the execution of a written engagement agreement signed by the Firm.

Please do not transmit confidential, sensitive, or time-sensitive information through the Site until an attorney-client relationship has been established. Unsolicited information submitted through the Site may not be treated as privileged or confidential, and its submission will not preclude the Firm from representing a party adverse to you in any matter.

Information You Provide Directly. We collect personal information that you voluntarily provide to us through the Site, including when you submit a contact or consultation request form, subscribe to firm news or publications, or otherwise communicate with us. This information may include your name, email address, telephone number, mailing address, employer, and the contents of your message, including any description of your legal matter that you choose to provide.

Information Collected Automatically. When you visit the Site, we and our third-party service providers automatically collect certain information about your device and your use of the Site through cookies, pixels, server logs, and similar technologies. This information may include:

We do not knowingly collect sensitive personal information (such as Social Security numbers, financial account credentials, or health information) through the automatic data-collection technologies on the Site, and we ask that you not include such information in any web form submission.

Google uses this information on our behalf to compile aggregated reports about Site activity and to provide other services relating to Site usage. Google may also use the data it collects for its own purposes, including to maintain and improve its own services, and may combine it with other information available to Google, in accordance with Google’s own privacy policy. We do not control, and we are not responsible for, Google’s independent collection, use, retention, or disclosure of this information.

By continuing to use the Site without disabling these technologies, you consent to the collection and processing of data about your use of the Site by Google in the manner and for the purposes described above.

We do not use Google Analytics advertising features, remarketing, or cross-device identification on the Site, and we have not configured the Site to display third-party advertisements.

7. “Do Not Track” Signals and Global Privacy Control

Some browsers transmit “Do Not Track” (“DNT”) signals or universal opt-out signals such as the Global Privacy Control (“GPC”). Because no uniform standard has been adopted for how websites should respond to DNT signals, the Site does not currently respond to DNT signals. Because we do not sell personal information or share it for cross-context behavioral advertising, we do not currently process GPC signals as opt-out requests; if our practices change, we will update this Privacy Policy and our Site accordingly. You may limit cookie-based tracking through the tools described in Section 4.

Several states, including California, Virginia, Maryland, New Jersey, and Delaware, have enacted comprehensive consumer privacy laws that grant residents certain rights with respect to their personal information. These laws generally apply only to businesses that meet specified thresholds relating to revenue or the volume of personal information processed, and the Firm may not be subject to them. Nevertheless, regardless of where you reside, you may submit the following requests to us, which we will honor to the extent required by applicable law and consistent with our professional and legal obligations:

If we decline to act on your request and you reside in a state whose law provides an appeal right, you may appeal our decision by replying to our response with the subject line “Privacy Request Appeal,” and we will respond as required by applicable law.

California “Shine the Light.” California Civil Code Section 1798.83 permits California residents to request certain information regarding the disclosure of personal information to third parties for those parties’ direct marketing purposes. The Firm does not disclose personal information to third parties for their direct marketing purposes.

Categories Disclosed (California). For purposes of California law, in the preceding twelve months we have collected the categories of personal information described in Section 3 (identifiers, internet and network activity information, approximate geolocation, and professional information voluntarily provided), which we obtain directly from you and from your device; we use them for the purposes described in Section 5; and we disclose them to the categories of recipients described in Section 6. We do not sell personal information, we do not share personal information for cross-context behavioral advertising, and we do not use or disclose sensitive personal information for purposes requiring a right to limit under California law. We do not knowingly collect or sell the personal information of minors under sixteen years of age.

We use commercially reasonable administrative, technical, and physical safeguards designed to protect the personal information we collect through the Site. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee the absolute security of your information. Any transmission of information through the Site is at your own risk.

We retain personal information collected through the Site for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including to respond to your inquiry, maintain conflicts-check records, comply with our legal, regulatory, and professional obligations, resolve disputes, and enforce our agreements. The Site is not directed to children under the age of thirteen, and we do not knowingly collect personal information from children under thirteen. If you access the Site from outside the United States, you understand that your information will be transferred to, processed, and stored in the United States, where data protection laws may differ from those of your jurisdiction, and you consent to such transfer and processing.

When we do, we will revise the “Last Updated” date above and post the updated policy on this page. Material changes will apply prospectively from the date of posting.
